These General Terms and Conditions of Sale (the “Terms”) govern all inflight catering, provisioning, and related concierge services supplied by Global Diners (“the Company”) to its clients (aircraft operators, charter companies, handling agents, flight departments, and private principals). Placing an order constitutes the client’s full and unreserved acceptance of these Terms.

ARTICLE 1  ORDERS & ACCEPTANCE

Each order is firm and binding only once Global Diners has issued a written confirmation to the client, by email or SMS. Requests communicated verbally or by telephone are not binding on the Company until confirmed in writing. By confirming an order, the client acknowledges having read and accepted these Terms in full.

ARTICLE 2  PRICES & VAT

Unless stated otherwise, prices are quoted exclusive of VAT (Value Added Tax); all other applicable duties and taxes are included. Quotations are valid for the period indicated on them and remain subject to availability and to the price conditions set out in Article 23.

ARTICLE 3  DELIVERY, LOADING & HANDLING CHARGES

Delivery, loading, and handling fees vary according to the airport, FBO or handler, the time slot, and the requested delivery hours. These charges are quoted on request and confirmed with each order.

ARTICLE 4  SHORT-NOTICE ORDERS

Any order confirmed less than six (6) hours before the requested delivery (loading) time will be charged a surcharge of 30% of the total order value, subject to the Company’s acceptance and operational feasibility.

ARTICLE 5  COURIER & EXPRESS CHARGES

Certain special, bespoke, or last-minute requests may require dedicated courier or express transport. This service is billed per hour, with a minimum charge of one (1) hour; each additional hour, whether complete or partial, is billed as a full hour.

ARTICLE 6  ORDER AMENDMENTS

Any amendment to a confirmed order (additions or removals) must reach Global Diners in writing at least two (2) hours before the delivery time. Failing this, items removed will be invoiced at the original order value. Any reduction exceeding 30% of the original order is treated as a partial cancellation under Article 7.

ARTICLE 7  CANCELLATION

All cancellations must be made in writing (email). Cancellations by telephone are not accepted. In the event of partial or full cancellation, for any reason — including flights cancelled due to the inability to refuel — the following applies:

  • 24 hours or more before the requested delivery time: no charge, except for special raw materials specifically purchased for the order that cannot be returned or reassigned to other flights.

  • Between 6 and 24 hours before delivery: only food already prepared and non-food items purchased specifically for the order are charged. Note that production generally begins less than twelve (12) hours before delivery.

  • Less than 6 hours before delivery: the order is charged in full.

Materials purchased for confirmed orders. If a confirmed order is subsequently cancelled, any raw materials specifically purchased for it will be charged where they cannot be returned or repurposed for other flights. Global Diners will make every effort to minimise such charges by reallocating items wherever possible. The amount invoiced reflects the net cost of materials only, with no added commission or mark-up.

ARTICLE 8  SPECIAL & LUXURY SOURCING

Rare, seasonal, or luxury items procured specifically for a client — for example caviar, specific wine or spirit vintages, dishes prepared with Michelin-partner houses, bespoke floral arrangements, or other custom provisions — are non-cancellable once procured. Where such items cannot be reassigned, they are charged at net cost regardless of the cancellation timing set out in Article 7.

ARTICLE 9  ALLERGENS, DIETARY & RELIGIOUS REQUIREMENTS

The client must communicate, in writing and at the time of ordering, all allergies, intolerances, and medical or religious dietary requirements (including halal, kosher, vegan, and gluten-free needs) for every passenger concerned. While Global Diners applies rigorous controls, its kitchens handle all regulated allergens and the absolute exclusion of cross-contamination cannot be guaranteed. The Company accepts no liability for any adverse reaction where the relevant requirement was not disclosed to it in writing before preparation.

ARTICLE 10  FOOD SAFETY, COLD CHAIN & HANDOVER

All food is prepared in accordance with applicable food-safety (HACCP) standards. Responsibility for the cold chain, onboard storage, refrigeration, reheating, and service passes to the client, the operator, or the receiving crew or handler at the moment of handover or loading. Recommended consumption windows and storage temperatures are provided on request. Global Diners is not liable for spoilage, deterioration, or any consequence arising from improper storage, handling, or service after handover.

ARTICLE 11  EQUIPMENT, TABLEWARE & RETURNABLE ITEMS

Trolleys, porcelain, crystal, linen, casseroles, and any equipment supplied on loan remain the property of Global Diners unless expressly sold. Returnable items must be returned clean and undamaged within a reasonable period. Loss of, or damage to, such items is invoiced to the client at full replacement value.

ARTICLE 12  CONDITIONS OF PAYMENT

Except where a credit account or specific arrangement has been agreed in writing in advance, the Company’s standard terms are strictly payment before delivery.

ARTICLE 13  ACCEPTED PAYMENT METHODS & CURRENCIES

Invoices may be settled in cash (within applicable legal limits), by credit card, or by bank transfer. The Company accepts American Express, VISA, and MasterCard. Payment may be arranged in several currencies (EUR, USD, GBP, and others) by prior agreement; any foreign-exchange conversion and associated bank charges are borne by the client.

ARTICLE 14  LATE PAYMENT

Any overdue amount automatically bears interest at the contractual late-payment rate stated on the invoice, in accordance with applicable law, together with the fixed statutory recovery indemnity and any reasonable additional recovery costs incurred. Should a payment fall overdue, Global Diners reserves the right to suspend, without further notice, all current orders of any client in debt to the Company.

ARTICLE 15  VAT-EXEMPT & TAX-FREE SUPPLIES

Aircraft operators eligible under applicable EU and national rules — broadly, carriers operating chiefly on international routes — may benefit from VAT-exempt (zero-rated) supply. To apply such treatment, the operator or its representative must provide Global Diners with valid supporting documentation, including a current Air Operator Certificate (AOC). In the absence of valid proof of eligibility, VAT is charged on each item in accordance with the applicable tax law.

ARTICLE 16  CLAIMS & COMPLAINTS

Any claim relating to the goods or service supplied must be submitted in writing within twenty-four (24) hours of delivery. Any claim or complaint relating to an invoice must be sent by email or letter within eight (8) days of the invoice date. Claims received after these periods cannot be considered.

ARTICLE 17  FORCE MAJEURE

Global Diners is not liable for any delay, non-performance, or suspension of its obligations, in whole or in part, resulting directly or indirectly from any event beyond its reasonable control — including official traffic or slot restrictions, strikes, fire, flood, accident, breakdown, traffic congestion, inability to obtain materials, war, civil unrest, adverse weather, epidemic, or any governmental act or regulation. Where the Company itself cancels for such reasons, any sum already paid by the client is refunded.

 

ARTICLE 18  LIMITATION OF LIABILITY

Save in cases of liability that cannot lawfully be excluded, the total liability of Global Diners in connection with any order is limited to the value of that order. The Company is not liable for indirect or consequential losses, including missed slots, flight delays, or reputational harm, however arising.

ARTICLE 19  CONFIDENTIALITY & DATA PROTECTION

Global Diners treats all client, passenger, itinerary, and order information as strictly confidential and processes personal data in accordance with the applicable data-protection legislation (notably the GDPR). The Company does not disclose the identity, movements, or preferences of any client or passenger to third parties save as required to fulfil the order or by law. The client undertakes a reciprocal duty of confidentiality with respect to the Company’s pricing and methods.

ARTICLE 20  INTELLECTUAL PROPERTY

All menus, recipes, food presentations, designs, and documentation created by Global Diners remain its exclusive intellectual property and may not be reproduced, distributed, or used by the client or any third party without the Company’s prior written consent.

ARTICLE 21  CUSTOMS & CROSS-BORDER CATERING

The client and the operator are responsible for ensuring that catering loaded onto an aircraft complies with the customs, import/export, and biosecurity rules in force at every point of departure and arrival — including restrictions on meat, dairy, fresh produce, and alcohol. Global Diners accepts no liability for the seizure, confiscation, or rejection of any item by the competent authorities.

ARTICLE 22  GOVERNING LAW & JURISDICTION

These Terms are governed by International law. Any dispute is subject to the jurisdiction of the competent courts of the place where the catering is delivered or, failing that, of the courts having jurisdiction over the registered office of Global Diners.

ARTICLE 23  PRICE CONDITIONS & GENERAL PROVISIONS

Availability and pricing may change during the validity of the Global Diners menu. The final price for any order may be requested from the Company at any time. Prices are quoted in the currency of the country where the catering is delivered, exclusive of tax. The full list of these Terms is available on request. Should any provision be held unenforceable, the remaining provisions continue in full effect.
